Welcome to cinkers.com (the "Platform"), operated by Zinkbulb SL (the "We" or "Our"). These Terms and Conditions (the "Terms") govern your access to and use of the Platform and all services, tools, and features offered through it, including, but not limited to, artificial intelligence-powered content generation and AI-based chat support (the "Services").

By accessing, registering for, or using the Platform in any way, you (hereinafter, "You" or "User") confirm that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy [View here], which is incorporated by reference. If you do not agree with any of these Terms, you must not access or use the Platform.

SERVICE DESCRIPTION

cinkers.com is a Generative Artificial Intelligence platform that allows users to interact with AI models to generate various types of content, obtain information, receive support, and use other related tools. The Services are provided "as is" and are subject to change or discontinuation at our sole discretion.

ELIGIBILITY AND USER ACCOUNTS

To use the Platform, you must be at least 18 years of age or the legal age of majority in your jurisdiction. If registration is required, you agree to provide accurate, current, and complete information during the registration process and to keep such information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.  

ACCEPTABLE USE OF THE PLATFORM

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You are expressly prohibited from:

• Use the Platform in any way that violates applicable laws or regulations.
• Generate content that is unlawful, harmful, threatening, abusive, defamatory, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
• Attempt to gain unauthorized access to the Platform, other accounts, computer systems, or networks connected to the Platform.
• Interfere with or disrupt the operation of the Platform or any servers or networks connected to it.
• Use the Platform to develop a competitive product or service.
• Infringing the intellectual property rights of third parties or cinkers.com.

INTELLECTUAL PROPERTY

Our Property: The Platform, including its software, source code, design, logos, text (excluding user-generated content), graphics, interfaces, and the selection and arrangement thereof, are the exclusive property of [Legal Name of the Company that owns cinkers.com] or its licensors and are protected by intellectual property laws. User-Generated Content: Subject to these Terms and the limitations of the underlying technology, you retain ownership rights in the original content you input into the Platform ("Input") and in the content generated specifically for you by AI from your Input ("Output"). However, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process your Input solely for the purposes of providing the Services to you and improving the Platform (for example, to train AI models on an anonymized and aggregated basis).

DISCLAIMER REGARDING AI CHAT ASSISTANCE AND OTHER GENERATED CONTENT

Nature of AI: The Platform uses generative artificial intelligence models. AI chat assistance and any other AI-generated content, suggestions, responses, or information (hereinafter, "AI Content") are provided for informational purposes only and as a support tool. NOT PROFESSIONAL ADVICE: AI Content DOES NOT CONSTITUTE, NOR SHOULD IT BE CONSTRUED AS, PROFESSIONAL ADVICE of any kind, including, but not limited to, legal, financial, tax, medical, health, or any other regulated field or advice requiring specialized knowledge. AI is not a licensed professional or a substitute for the advice of a qualified expert. Accuracy and Reliability: AI may generate AI Content that is inaccurate, incomplete, biased, outdated, or inappropriate for your specific circumstances. We do not guarantee the accuracy, reliability, timeliness, or suitability of any AI Content. USER'S SOLE RESPONSIBILITY: You are SOLELY RESPONSIBLE for evaluating the accuracy, appropriateness, and usefulness of any AI Content. All decisions, actions, or inactions you make based, in whole or in part, on the AI ​​Content are your sole responsibility and risk. DISCLAIMER: To the fullest extent permitted by law, cinkers.com and Zinkbulb SL, their affiliates, directors, employees, and agents, DISCLAIM ALL LIABILITY for any loss, damage, cost, or expense (direct or indirect) arising from or in connection with your reliance on or use of the AI ​​Content. You agree not to hold us liable for any consequences arising from your use of the AI ​​Content.

GENERAL EXCLUSION OF WARRANTIES

The Platform and Services are provided "as is" and "as available," without warranties of any kind, either express or implied. We disclaim all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, secure, error-free, free of viruses or other harmful components.  

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, in no event shall cinkers.com, Zinkbulb SL, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Platform; (ii) any conduct or content of any third party on the Platform; (iii) any content obtained from the Platform (including AI Content); and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not we have been advised of the possibility of such damage.  

COMPENSATION

You agree to defend, indemnify, and hold harmless cinkers.com, Zinkbulb SL, and their respective officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including, but not limited to, attorneys' fees) arising from: (i) your use of and access to the Platform; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including, but not limited to, any copyright, property, or privacy right; or (iv) any claim that your content caused damage to a third party.  

MODIFICATIONS TO THE TERMS

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 15 or 30 days' notice prior to any new terms taking effect (for example, via a notification on the Platform or by email). What constitutes a material change will be determined at our sole discretion. Your continued use of the Platform after such changes become effective constitutes your acceptance of the new Terms.  

TERMINATION

We may suspend or terminate your access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms. You may stop using the Platform at any time. All provisions of the Terms which, by their nature, should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.  

APPLICABLE LAW AND JURISDICTION

These Terms will be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts of Madrid, Spain, for the resolution of any dispute arising from or related to these Terms or your use of the Platform.  

MISC

These Terms constitute the entire agreement between You and Us with respect to the Platform and supersede all prior or contemporaneous agreements. If any provision of these Terms is held invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
